The services are operated by Bright Cake. We are registered in the United Kingdom with our registered office at 2 Fir Tree Place, Church Road, Ashford TW15 2PH, UK. Our contact number is 01784 278525.
2. Accessing the Service
Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the services we provide through the Site without notice. We will not be liable if for any reason any of the Services are unavailable at any time or for any period. Personal data provided by you is processed by us in accordance with our Privacy Policy.
3. Ordering Cakes with Pictures
Choose a clear picture and text you want on your cake.
Ensure the picture is of high resolution to avoid pixelation.
Only JPEG format files are accepted. We cannot process PDFs or Word documents.
If there’s no upload option, email your picture to hello@brightcake.co.uk with your order number in the subject line.
The cake decorator has the discretion to crop pictures and position messages.
You are responsible for ensuring you have the right to use any images you provide us with.
4. Disclaimer of Warranties and Limitation of Liability
The Site and the Services are provided “as is” and we disclaim all warranties to the fullest extent permitted by law.
We do not guarantee that our Site will be free from bugs, viruses, or hacking attempts.
Our liability is limited to the purchase value of the product in case of errors, misdelivery, or other issues. We are not liable for any consequential damages.
5. Payment Methods
All payments for products on the Site can be made through debit or credit card. We process payments as the commercial agent for the Seller. All prices will be displayed in GBP.
6. Delivery and Collection
Cakes must be collected on the agreed date and time. If uncollected, cakes will be kept for no more than 24 hours and will not be the responsibility of the store after this period.
Delivery is not guaranteed at a specific time. If no one is available to accept the delivery, the cake will be returned to the store, and it will be your responsibility to collect it.
In case of damaged cakes upon delivery, please contact the store immediately with photos for a refund.
7. Returns / Cancellations
Cakes made to order cannot be canceled within 24 hours of the collection time.
No refunds will be issued for uncollected cakes or cakes canceled within 24 hours of collection.
We will not be responsible for the condition of cakes once they have been transported or stored improperly.
8. Links
Our Site may provide links to third-party websites for informational purposes. We do not endorse any third-party websites and are not responsible for their content.
9. Viruses, Hacking, and Other Offenses
You must not introduce viruses or attempt unauthorized access to the Site. Breaches may result in legal action.
10. Customer Conduct
You agree not to misuse the Site for any unlawful purposes. Any harmful material sent to or from the Site is prohibited.
11. Privacy and Data
Your personal data will be processed in accordance with our Privacy Policy, which you can review on the Site. We may share your contact details with our drivers for delivery purposes, but they are not permitted to share your information with any third parties.
12. Force Majeure
We are not liable for any delay or failure to perform our obligations due to events outside our control, such as natural disasters or unforeseen delivery issues.
13. Governing Law
These Customer Terms and all transactions are governed by English law. Any disputes will be subject to the exclusive jurisdiction of the courts of England.
